Traduality Language Solutions, Inc. respects your privacy and is committed to protecting it through our compliance with this policy. Please read this policy carefully to understand our policies and practices regarding your information and how we will use and disclose your information that you make available to us.

By accessing the Website or using the Services, you agree to this Privacy Policy; if you do not agree with our policies and practices, your choice is not to use the Services. Our Terms of Use (located at https://traduality.com/terms-of-use) is incorporated herein by reference, and capitalized terms used herein have the meaning set forth in the Terms of Use.

We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means of posting a notification on this site or by other means if required by law. We may make non-substantive updates or clarify existing provisions without notifying you. It is your responsibility to review this site and this Privacy Policy periodically and to be aware of any modifications. Your continued use of the site after such modifications will constitute your acknowledgment of the modified Privacy Policy and you agree to be bound by the modified Privacy Policy.

1. The Information We Collect.

    1.1. We may collect certain information from you or about you, including information described in the categories below (collectively, “Information”):

         A. Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, a particular person or household, such as your name, email address, date of birth, address, and other personal information (“Personal Information”).

         B. Information regarding how the Services are accessed and used by you, including but not limited to your access times, browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, content you have accessed or seen, the time spent on the Website, IP host address, web pages viewed, operating system, referring service, search information, device type, page views, usage and browsing habits on the Service, and other similar data (“Usage Data”).

    1.2. How we collect Information from you is further described in this Policy; however, if any Information is provided to us in any manner by any User, this Privacy Policy will apply to such Information.

    1.3. It is possible at times when collecting non-personally identifiable information through automatic means that we may unintentionally collect or receive personally identifiable information that is mixed in with the non-personally identifiable information. While we will make reasonable efforts to prevent such incidental data collection, you understand the possibility still exists.

2. Collection of Information. Usage Data and is collected for every User of the Website, and may be collected whether or not you have an Account. Personal Information is collected when you submit such Personal Information about yourself, including when you create an Account. We collect Information directly from you when you provide it to us through the use of any of our Services; automatically as you navigate through the Website and Services; and from certain third parties who we have engaged to perform services for us or who may collect such data from you subject to their own policies. We may also collect Information from you when you open an email or other communication from us or click through any option on that communication.

3. Cookie Information. “Cookies” are pieces of information that may be placed on your computer by a service for the purpose of facilitating and enhancing your communication and interaction with that service. Many services use cookies for these purposes. We may use cookies (and similar items such as clear gifs, web beacons, tags, etc.) on our Services to customize your visit and for other purposes to make your visit more convenient or to enable us to enhance our Services. 4. How We Use Your Information. We may use your Information in the manners set forth below.

    4.1. We will use your Information to operate the Website, to perform or fulfill Services requested by you, to deliver information to you about our Services (including additional Services that may be of interest to you), to improve and tailor services to better fit our Users, to inform you of changes to our Website or our policies, to solicit additional information from you from time to time, and to provide information about Traduality’s current Services and any updated or additional Services.

    4.2. We may use your Information to resolve disputes, troubleshoot problems, respond to inquiries or requests and enforce our agreements with you, including our policies, and complete any purchases you make through the Website.

    4.3. We may use your Information to perform analytics services, including through Google Analytics. This is a web-based analytics tool that helps website owners understand how visitors engage with their website. It allows us to view a variety of reports about how visitors interact with their website so that they can improve it. The information generated by these services about your use of the Services (including your IP address or a truncated version of your IP address) is transmitted to and stored by analytics service providers on their servers. You may be able to out of the Analytics Service without affecting how you visit our site, by visiting https://tools.google.com/dlpage/gaoptout or reaching out to us.  

    4.4. We may use your Information for any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such Information.

5. Disclosure of Your Information. We will not sell your Personal Information. However, we may disclose and share Information with third parties as set forth below.  

    5.1. We may share your Information with our subsidiaries and affiliates, and with contractors, service providers, and other third parties who we have engaged in order to continue to develop our Website, improve our Services, and provide the Services to you. For example, we may share your Information with IT service providers, such that they may support our IT systems, provide hosting, processing, and analyzing services with respect to information and data collected, and with third parties who process and email communications to our users on our behalf.  

    5.2. We may share your Information as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated, provided that, if in connection with such sale, merger, or other reorganization, the collection, use, or disclosure or your Information will differ from this policy, you will receive  a notification of the same as provided herein above, and you may terminate your Account in your discretion.

    5.3. We may share your Information in response to legal processes, court orders, or government or regulatory requests; to enforce other agreements with you, including for billing and collection purposes; and if we believe disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, to verify or enforce compliance with the policies governing our sites and applicable laws or as otherwise required or permitted by law or consistent with legal requirements.

    5.4. We may share your Information with credit card issuers and financial institutions in order to obtain payment from you, such that they may process payments and refunds, verify the absence of fraud, or assist in debt collection, in the course of the performance of a contract or on the basis of other legitimate interests.

    5.5. We may share your Information as appropriate to protect us, other Users, and third parties if we believe that you may harm, or have harmed, the property or rights of Traduality, other Users, or any other third party, to report, disclose, limit, respond to, or prevent such conduct or activity.

6. De-Identified Information. We may create aggregated and/or de-identified data sets or other information based on the Information we obtain from you, including as may be derived from your Personal Information (collectively, “De-Identified Information”). This information is no longer capable of identifying you. In addition to the general use and disclosure of all Information set forth herein, we may use De-Identified Information (including for clarity, Usage Data) for any purpose we determine is appropriate, in accordance with any legal restrictions, including using the same for our marketing purposes or selling the same. De-Identified Information is the property of Traduality.

7. Your User Content.  Information which you voluntarily include and transmit online on the Service or in a publicly accessible blog, chat room, social media platform, public profile on the Website, or otherwise online, or that you share in an open forum such as an in-person panel or survey, may be viewed and used by others without any restrictions.  We are unable to control such uses of your personally identifiable information, and by using the Service or any other online services you assume the risk that the personally identifiable information provided by you may be viewed and used by third parties for any number of purposes.

8. Third-Party APIs. To the extent that we allow you to log in to an Account or access our Services using a third party API, or if we offer an API tool to a third party, you should be aware that information you provide upon log in may be shared with the party offering the API, or the party which uses our API. You should read the policies of such third party before submitting any Information.

9. Children. This Website is intended for users over the age of 16. We do not knowingly collect Personal Information from individuals under 16. If you become aware that an individual under 16 has provided us with Personal Information, please contact us.

10. Territory. Traduality is located in the United States, and our servers are maintained in the United States. You understand that data stored in the United States may be subject to lawful requests by the courts or law enforcement authorities in the United States. If you access the Website from outside of the United States, or transfer information into the United States from a foreign country, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction, and you give us express permission to transfer such data to our servers in the United States.

11. Your Choices Regarding Your Data. Your Account may provide you with certain options with respect to Information we collect from you, and we may provide you with the option to update or delete certain Information that we may have about you. If you delete certain information, or decline to share certain Information with us, we may not be able to provide to you some of the features and functionalities otherwise available via the Website.

12. Communications with Us. By using certain Services we offer, you expressly consent to receive in-product communications from us, as well as push notification from our mobile application. You may also receive other communications from us when we deem necessary or appropriate, including by text or phone call. Message and data rates may apply, and any Information you provide in response to any such communications is subject to this Policy. You may be able to opt out of certain communications by accessing your Account or the mobile application, or reaching out to us. However, please be aware that you may be unable to access certain functions of the Website if you opt out of certain communications.

13. Account Closure & Deletion. We will retain your Information for the entire time that you keep your Account open. After you close your Account, we may retain your Information: (i) for as long as necessary to comply with any legal requirement, to protect our legal interests, or otherwise pursue our legal rights and remedies; (ii) on our backup and disaster recovery systems in accordance with our backup and disaster recovery policies and procedures; and (iii) for Information that has been de-identified, anonymized, and/or aggregated in such a manner that it is no longer capable of identifying you, indefinitely.

14. Security of Information. We have put in place industry-standard procedures to safeguard and help prevent unauthorized access, to maintain data security, and to correctly use the Information we collect online. Unfortunately, we cannot guarantee that 100% of the data transmissions are secure. Therefore, while we strive to protect your Personal Information, you acknowledge that: (a) there are limitations to security and privacy of the Internet that are beyond our control; (b) the security, integrity and privacy of the Personal Information exchanged between you and us cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party. For any payments to Traduality, we may use a third-party payment processor to better ensure the security of your payment information. Such third-party processor may have its own Terms of Use and Privacy Policy. We recommend that you review such third-party policies when making a payment to us to understand the security measures such third-party has taken regarding your payment information.

15. Consent Revocation and Opt-Out. To the extent we rely on your consent to process any Information, you may revoke that consent at any time. If you wish to revoke such consent, or if at any time you do not wish to receive the communications stated herein from Traduality, you may do so by unsubscribing, opting out through your Account, or reaching out to us at [email protected].

16. Third-Party Services. This document only addresses the use and disclosure of Information that you provide to us. Other sites accessible through our Website from time to time may have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy and terms of use. We are not responsible for the policies or practices of third parties. You should contact those third parties directly if you have any questions about their policies and practices regarding your information.

17. Your Rights Under US State Laws. In the United States, depending on your state of residence, and subject to certain exceptions, you may have some or all of the following rights:

    17.1. Right to Know: The right to request that we disclose to you the Personal Information we collect, use, or disclose, and to access the same.

    17.2. Right to Request Correction: The right to request that we correct inaccurate Personal Information that we maintain about you.

    17.3. Right to Request Deletion: The right to request that we delete Personal Information that we have collected from or about you. (Please note that you may not be able to maintain an Account through the Website without our retention of certain Personal Information.)

    17.4. Right to Portability: The right to obtain a copy of your Personal Data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller.

    17.5. Right to Opt Out: The right to opt out of the processing of your Personal Information for purposes of targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

To submit a request to exercise your rights set forth in this Section 16, and as applicable, to appeal a consumer rights action, you may use [email protected]. We may require that you verify your identify to respond to your request. If you are entitled to a substantive response, we will deliver the requested information to you within 45 days (or will inform you that an extension of such timeframe is necessary). You may make a request up to twice during a 12-month period. We will not discriminate against you for exercising your rights pursuant to applicable state laws.
